Rules for using PIKSPOT!, account responsibilities, user content and disclaimers.

Welcome to PIKSPOT! (the “Service”). PIKSPOT! is a fan-made website that provides information organization, community interactions and tools for Pikmin Bloom players.

These Terms of Service (the “Terms”) govern your access to and use of PIKSPOT!'s website, web application features, content, accounts and related services (collectively, the “Service”). PIKSPOT! is currently provided as a website, not a native app. If we provide an app, PWA installation features or other forms of service in the future, we may supplement or update the relevant terms.

By accessing or using the Service, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree, do not use the Service.

Article 1. Scope

  1. These Terms apply to your access to and use of the Service, including its pages, features, content, account mechanisms and interactions.
  2. The Service may publish additional rules, explanations, notices or policies for specific features, pages or interactions. Unless expressly stated otherwise, they form part of these Terms.
  3. If these Terms conflict with additional rules for a specific feature, those additional rules take precedence within the scope of that feature.

Article 2. Nature of the Service and Unofficial Status

  1. PIKSPOT! is a fan-made utility and community website intended to help players organize information, share experiences, submit reports, track collections and interact with the community.
  2. PIKSPOT! is not an official website, product, platform, partner, agent or authorized service of Pikmin Bloom, Nintendo, Scopely, Scopely Explore (formerly the Niantic games team) or any related rights holder.
  3. Rights to game names, character names, trademarks, logos, images and other related materials mentioned in the Service belong to their respective rights holders.
  4. The Service uses such names and materials only for identification, explanation, commentary, information organization, community discussion or other lawful and necessary purposes.
  5. The content, tools, user submissions and results of community interactions provided by the Service do not represent any rights holder's official position, endorsement, guarantee or approval.

Article 3. Eligibility

  1. You may use the Service only if you have the legal capacity to agree to these Terms under the laws applicable to you.
  2. If you are a minor under the laws of your location, or parental, guardian or other legal representative consent is required, you must obtain appropriate authorization before using the Service.
  3. If you do not meet these conditions, do not use the Service.
  4. PIKSPOT! does not require your date of birth. Not requesting it does not mean that the Service has verified that you are an adult. You remain responsible for ensuring that you meet the eligibility and authorization requirements of your local laws.

Article 4. Accounts and Access

  1. Some content can be browsed without registration. Certain features may require an account, sign-in or relevant information.
  2. You agree to provide truthful, complete and non-misleading information when creating or maintaining an account.
  3. You are responsible for keeping your sign-in credentials secure and for all activity under your account.
  4. You may not sell, transfer, rent, lend, share or otherwise make your account available to others.
  5. Notify us promptly if you believe your account has been accessed without authorization or your sign-in information may have been compromised.
  6. Where necessary to protect the Service, other users or third parties, we may require re-verification, suspend access or take other reasonable security measures.

Article 5. Acceptable Use

You agree not to engage in, assist, encourage or cause others to engage in any of the following:

  1. Violating applicable laws, regulations or legal obligations;
  2. Infringing others' rights, including intellectual property, privacy, personality, reputation or other lawful rights and interests;
  3. Impersonating a person or entity, or misrepresenting your identity, relationships or the source of content;
  4. Submitting, posting, transmitting or distributing unlawful, fraudulent, misleading, harassing, threatening, hateful, discriminatory, obscene or otherwise inappropriate content;
  5. Collecting, disclosing, publishing or misusing others' personal data without a lawful basis;
  6. Interfering with, damaging, attacking, testing, circumventing or endangering the security, integrity or normal operation of the Service;
  7. Using bots, crawlers, batch scripts, automation tools or similar means to access, extract, monitor, copy or manipulate the Service in bulk, unless expressly permitted by the Service;
  8. Without the Service's express permission or prior written consent, directly embedding, integrating or supplying URLs for images, attachments or other static resources provided by the Service to third-party websites, apps, automated services or other products, or using the Service as a content delivery network (CDN), image host, download source or other hosting service. This provision governs only the use of PIKSPOT!'s service, hosting and bandwidth; it does not mean that PIKSPOT! claims ownership of, a license to, or the right to sublicense third-party game materials;
  9. Reverse engineering, decompiling or disassembling the Service, or attempting to obtain non-public source code, systems, APIs, logic or technical architecture, except as expressly permitted by applicable law;
  10. Evading restrictions, enforcement measures or account limitations, including by creating alternative accounts or using other identities to avoid moderation;
  11. Using the Service for spam, scams, phishing, malicious promotion, fake interactions or other abuse;
  12. Submitting or distributing misleading, dangerous or harmful information that could create real-world risks for others; or
  13. Engaging in other conduct that we reasonably determine could harm the Service, users, third parties or the integrity of the community.

Article 6. User Content

  1. The Service may allow you to submit, upload, post, share, store or display content, including text, images, comments, reports, coordinates, profile information, lists and other data (“User Content”).
  2. You remain responsible for your User Content and the consequences of submitting or sharing it.
  3. You represent and warrant that:
    • You have the right to submit the User Content;
    • Your User Content does not violate these Terms, relevant policies or applicable law; and
    • Your User Content does not infringe any third-party rights.

Image Uploads and Identifying Information

  1. If image uploads are available, you must check before uploading that the image is suitable for public display or display within the Service and does not contain information that can be linked to a real-world identity.
  2. You may not upload images containing the following unless you have a lawful basis and the content is consistent with the Service's purposes and relevant policies:
    • Real names, addresses, phone numbers, email addresses, account credentials, identity documents, tickets, receipts or other personally identifying information;
    • Private chats, private social media pages, private notifications, private documents or content disclosed without consent;
    • Identifiable photos of people, photos of children or young people, license plates, home address signs, workplaces, schools or other information that could reveal a real-world identity or location;
    • Content subject to others' copyright, trademark, likeness, privacy or other rights that you are not authorized to use.
  3. The image upload process may require a confirmation such as: “I confirm that the image does not contain information that can be linked to a real-world identity, such as real names, addresses, contact details, private chats or photos of faces.” This confirmation does not release you from your responsibilities under these Terms or applicable law.
  4. We are not required to review all images in advance, but may reasonably review, reject, remove, restrict, flag, compress, convert or otherwise manage image content.
  5. To operate, maintain, improve, review and provide the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, reproduce, convert formats, display, transmit, index and process your User Content to the extent reasonably necessary.
  6. This license does not affect your ownership of your User Content.
  7. Deleting User Content or your account may not result in immediate or complete removal in every circumstance. Content may, for example, be retained for backups, security, legal compliance or dispute resolution, or where it has been shared, quoted or reasonably relied upon by others.

Article 7. Moderation and Enforcement

  1. To protect the Service, users, third parties and community order, we may take reasonable measures concerning content or conduct that may violate these Terms, relevant policies or applicable law.
  2. Such measures may include:
    • Removing, restricting, hiding, flagging or disabling content;
    • Restricting features or reducing visibility;
    • Issuing warnings;
    • Requesting explanations, additional information or corrections;
    • Suspending or terminating accounts; or
    • Taking technical measures to prevent abuse or repeated violations.
  3. For security, legal, abuse prevention or other urgent operational reasons, we may take these measures without prior notice to the extent reasonably necessary.
  4. We are not required to review every report or respond individually to every dispute.
  5. We reserve the right to interpret and enforce these Terms reasonably in light of the nature and purpose of the Service.

Article 8. Third-Party Services, Advertising and External Links

  1. The Service may integrate or link to third-party services, such as authentication, hosting, infrastructure, databases, external pages, advertising or other tools.
  2. The Service has technical provisions for introducing third-party advertising in the future. If advertising is introduced, we may use Google AdSense or other advertising partners to help cover operating costs. Whether third-party advertising is enabled will depend on site-wide settings, page eligibility, user eligibility, regional regulations and consent status.
  3. If Google AdSense is introduced, the Service may display ads in sidebars, at the bottom of pages, in banners, within pages or between sections, or show skippable full-screen interstitial ads when moving between main pages. Unless stated otherwise, such interstitial ads are intended only for natural transitions between main pages, not between a page and its subpages or detail pages, during sign-in, before form submission, during image uploads, error handling, account management, reporting or review, or other critical workflows.
  4. Advertising may be supplied by third-party providers and may use cookies, local storage, device information, IP addresses, page views, interaction data or similar technologies to deliver, cap the frequency of, measure, improve or, where legally permitted and with necessary consent, personalize ads. Where consent is required by law or advertising service policy, the relevant non-essential advertising technologies should not activate before the necessary consent is obtained or if you refuse it.
  5. If memberships, subscriptions, one-time purchases or other ad-free benefits are offered in the future, their scope, conditions, duration and limitations will be described on the relevant pages, during purchase or in additional rules. Ad-free status is a product feature or service benefit, distinct from rejecting non-essential advertising cookies, personalized ads or setting other privacy preferences.
  6. Advertising, sponsored content, affiliate links and other promotional content do not constitute PIKSPOT!'s endorsement, guarantee or acceptance of responsibility for third-party products, services, websites or content.
  7. Third-party services are operated by their respective providers and may be subject to their own terms, privacy policies and operating rules.
  8. We are not responsible for the availability, content, security, legality or practices of third-party services.
  9. You decide whether to use third-party services, subject to their terms and policies.

Article 9. Intellectual Property

  1. Except for User Content and third-party materials, the Service and its original elements, including layouts, design, structure, interface elements, text, software and related content, belong to us or our licensors and are protected by applicable intellectual property laws.
  2. Subject to your compliance with these Terms, we grant you limited, non-exclusive, non-transferable and revocable permission to use the Service personally for its intended purposes.
  3. Except as permitted by applicable law or with our prior written consent, you may not reproduce, modify, distribute, sell, sublicense, publicly display, publicly perform, create derivative works from or otherwise exploit the Service.
  4. If you believe any content in the Service infringes your rights, contact us using the details below.

Article 10. Privacy

  1. Our collection and use of personal data are governed by the Service's Privacy Policy and related policies.
  2. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
  3. If you submit content containing others' personal data, you are responsible for ensuring that you have an appropriate lawful basis for doing so.
  4. When uploading images, avoid content containing real-world identifying information, private communications, photos of faces or other material that may infringe others' privacy.

Article 11. Support, Payments, Cancellations and Refunds

  1. PIKSPOT! may offer one-time support options to help cover website development and operating costs. These may include supporter status, nameplates or other digital benefits within the site, but are not donations to a charitable organization and do not qualify for charitable donation receipts.
  2. One-time support does not renew automatically. Payments are handled through PAYUNi's hosted payment page and the relevant financial institutions. PIKSPOT! does not request or store full credit card numbers or card security codes.
  3. Supporter digital benefits are generally provided immediately after successful payment. Once payment and digital benefits have been completed normally, refunds for a change of mind are not offered, except for accidental charges, duplicate or incorrect amounts, unauthorized transactions, failure to provide benefits due to system issues, payment processing errors, transaction disputes or mandatory legal requirements. See the Refund Policy for the detailed process.
  4. If monthly subscriptions become available, each period's service starts or continues upon payment. Cancellation stops future automatic charges only. Except for the circumstances in the preceding paragraph or mandatory legal requirements, a period that has already started will not be refunded in proportion to its remaining days. Prices, billing periods, renewals and cancellation methods will be clearly stated before payment.
  5. When a refund, reversal or transaction dispute is confirmed, PIKSPOT! may withdraw supporter status, nameplates or other digital benefits obtained through that payment. Free core features are not affected.

Article 12. Service Changes

  1. We may modify, update, suspend or discontinue all or part of the Service from time to time.
  2. Such changes may be made for operational, technical, legal, security, product planning or other legitimate reasons.
  3. We do not guarantee that any feature, page, content, user submission, record or service mechanism will remain available permanently, unchanged or uninterrupted.
  4. Where appropriate and feasible, we may give notice of significant service changes.

Article 13. Disclaimers

  1. The Service is provided “as is” and “as available.”
  2. To the fullest extent permitted by applicable law, we make no express, implied or statutory warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability or uninterrupted operation.
  3. Content in the Service, including user submissions, images, reports, location information, collection records, community interactions and game-related reference information, may be incomplete, inaccurate, outdated, subjective or unavailable.
  4. The Service is for general information, organization and community purposes only. You must decide for yourself whether to rely on any content or feature.
  5. We do not guarantee the accuracy, legality, safety or usefulness of User Content, third-party content, advertising content or external services.

Article 14. Limitation of Liability

  1. To the fullest extent permitted by applicable law, we and our affiliates, collaborators, service providers and related personnel are not liable for indirect, incidental, consequential, special, exemplary or punitive damages arising from your use of or inability to use the Service.
  2. Such damages include, without limitation, loss of data, profits, goodwill or opportunities, business interruption, or damage to devices or systems.
  3. These Terms do not exclude or limit liability that cannot be excluded or limited under applicable law.
  4. Where liability cannot be fully excluded by law, our liability is limited to the minimum extent permitted by law.

Article 15. Indemnification

To the extent permitted by applicable law, you agree to indemnify us, our collaborators, service providers and related personnel for claims, liabilities, losses, damages, costs or reasonable expenses arising from:

  • Your breach of these Terms;
  • Your violation of applicable law;
  • Your infringement of third-party rights; or
  • Your User Content or misuse of the Service.

Article 16. Changes to These Terms

  1. We may update these Terms from time to time.
  2. Updated versions will be published on the Service with a revised “Last updated” date.
  3. For material changes, we may provide additional notice where appropriate or required by applicable law.
  4. Continuing to use the Service after updated Terms take effect constitutes agreement to the revised Terms. If you disagree, stop using the Service.

Article 17. Governing Law and Dispute Resolution

  1. These Terms are governed by the laws of the Republic of China (Taiwan), without affecting any mandatory consumer protection rights you may have under the laws applicable in your place of residence.
  2. Unless applicable law requires otherwise, disputes arising from or relating to these Terms or the Service are subject to the jurisdiction of Taiwan's courts.
  3. Before initiating formal legal proceedings, you agree to contact us first and, where reasonably possible, attempt to resolve the dispute informally.
